Prerequisites
The knowledge of some of the contents of Constitutional Law
Learning outcomes
The knowledge of the sources of Regional Law, the regional form of government and the judicial review of legislation as reguards the relations between the State and the Regions. The second module focuses on administrative law profiles.
Course contents
The first part shows the relation between the regional State and the federal State and the evolution from the model founded upon the separation between the State and the Regions to a model founded upon the cooperation between the two. By showing the regional form of government and the sources of Regional Law, there will be discussions on the constitutional jurisprudence as reguards the system of competences introduced by the reform of 2001. The second module focuses on the issue of levels of government in the current legal space, where the regional dimension of the State intersects upwards with prominent shares of sovereignty ceded to the European Union and downwards with the recognition of local autonomy guaranteed by the article 5 of the Constitution, highlighting the mediation role that the system attributes to the Regions. Particular attention is paid to adminstrative law profiles.
The course aims to contribute to the realization of some of the objectives of the UN Agenda 2030, with particular attention to goals nn 3,4,5,10,16
Teaching methods
Frontal lectures and discussions on the cases of jurisprudence in the classroom.
