Learning outcomes
The course aims to explain fundamental institutions of environmental law and administrative function of the territorial planning, taking in consideration the recent changes in the legislation and case law.
Course contents
The course aims to offer a systematic framework of environmental and urban planning regulations, also through the analysis of case law. The course also aims to contribute to the realization of some of the objectives of the UN Agenda 2030, with attention to goals 11, 13, 14 and 15. The course is divided into two parts. The first part deals with the main characteristics of environmental law, the legal notion of Environment, principles of EU Environmental Law (i.e. sustainable development, the precautionary principle, the prevention principle; the source principle; the polluter pays principle), the environment in the Italian Constitution, in the European law and in the International law framework, techniques for environmental management: market-based v. command-and-control regulatory strategies, protection, management and planning of the landscape, nature reserves and protection of biodiversity, the administrative organization of the environment: state powers, local autonomies and the role of environmental associations, Strategic environmental assessment (SEA), Environmental impact assessment (EIA), Integrated Pollution Prevention and Control (IPPC), circular economy, waste management, renewable energies, climate change and air pollution, protection of water, environmental damage and liability.
The second part deals with the constitutional background concerning the administrative function of the territorial planning, with particular attention on private property guarantees, urban planning, control instruments on territorial transformation activities, building code, building permits, construction abuse.
Teaching methods
Frontal lectures with possible conferences and seminars.

G. ROSSI, Diritto dell’ambiente, Torino, Giappichelli, 2017 or last edition, limited to the following parts: First part all, second part only chapters IV e V, XI, XII, XIII e XIV, third part only chapters II, III e V.
C. Bevilacqua - F. Salvia, Manuale di diritto urbanistico, Padova, Cedam, 2017, except part 1 chapter 1 e part IV, except chapter 2.
Students also must know the constitutional rules and the foundamental laws referring to environment and territorial planning. Significant laws are available on online at the web page of the course.
For attending student all information about the class content, examinations and materials will be provided by the Professor during the lectures.

Oral examination. The subject of the exam is the contents of manuals and, limited to attending students, the contents of the lectures.
